Terms of Service

 BLACK STUMP PLUMBING AND GAS
By instructing Black Stump Plumbing and Gas to supply goods & services, the client acknowledges reading & agreeing to be bound by the terms of this agreement.

1. INTERPRETATION / DEFINITIONS

1.1 Business means Black Stump Plumbing and Gas
(ABN: 17 656 472 205) or any agents, contractors, or employees thereof.

1.2 Customer means the other party to the agreement for services.

1.3 Agreement means an agreement between the Business and Customer for the provision of plumbing and gas services. An agreement will come into existence on the date the Customer signs or approves the Authorisation in writing or verbally in accordance with these Terms and Conditions.

1.4 Website means the Business website www.blackstumpplumbing.com.au

1.5 Price means the Quotation Price as previously agreed with the Customer. The price can be adjusted by the Business in accordance with these Terms & Conditions as necessary.

1.6 Request for Services means a request for services submitted by the Customer to the Business detailing the scope of work sought.

1.7 Goods & Services means the goods and services supplied by the Business to the Customer in accordance with the Authorisation.

1.8 Site means the location where work is to be undertaken.

1.9 Subject to Change means these Terms & Conditions are subject to change without notice.

1.10 Acceptance of Terms means accepting the relevant Terms & Conditions stated herewith.

1.11 Signing means signing the Quotation or Invoice is a legal document and your acceptance of Black Stump Plumbing and Gas Terms & Conditions.

2. AUTHORISATION

2.1 The Customer must provide sufficient information when submitting a request for services to enable the Business to provide an accurate Authorisation and Quotation Price. Any deficiency in the Services caused by inadequate or inaccurate information provided in a Request for Goods & Services will be the Customer’s responsibility.

2.2 The Business will not be liable for any loss or damage caused as a result of the Customer’s inadequate or inaccurate information.

3. CUSTOMER OBLIGATIONS

3.1 The Customer will ensure that the Service Technician has clear and adequate uninterrupted access to the site at which the Services will be performed. The Business will not be liable for any loss or damage suffered by the Customer or their property as a result of inadequate access.

3.2 The Customer acknowledges that any building or construction sites where services are performed will comply with all applicable occupational health and safety laws.

3.3 The Business is not responsible for site cleanup unless agreed upon in writing.

3.4 If the Customer provides goods or services required for the work, the site must be prepared, and materials available at least 24 hours before the scheduled work commencement.

4. PAYMENTS & SUPPLY OF GOODS AND SERVICES

4.1 The Business’s fees & charges are subject to change without notification.

4.2 Price is payable in full without any deduction when goods & services are supplied unless otherwise agreed in writing.

4.3 Deposits & Progress Payments – A deposit of 20% may be required before work begins, with progress payments for larger jobs.

4.4 All goods remain the property of the Business until full payment is received.

4.5 Payment is due upon completion of work. Failure to pay upon completion constitutes a breach of contract.

4.6 In the event of non-payment, the Business may terminate work and recover all incurred expenses, including legal fees.

4.7 No deductions are permitted from invoices/payments for any reason unless expressly agreed.

4.8 Payment must be made via the Business’s accepted payment methods.

4.9 Late payments will incur a fee of 5% per week.

4.10 Labour costs will be charged in 1-hour increments, with a minimum call-out of 2 hours.

4.11 The Business’s quotation is based on a visual inspection, and variations may apply once work commences.

4.12 All work is performed to Australian Standards, including relevant Tasmanian regulations.

4.13 Quotes are valid for 14 days unless withdrawn earlier.

4.14 Customers may not cancel requests for services once accepted without covering material costs incurred.

4.15 The Business may cancel any request for services at any time without liability.

4.16 Changes to the scope of work will be charged as variations.

4.17 Additional fees apply for services outside business hours (Monday–Friday, 7:00 AM–4:00 PM).

4.18 Invoices shall NOT be itemised.

4.19 Debt Recovery – Unpaid invoices may be referred for debt collection, with recovery costs added.

5. REFUND POLICY

5.1 Refunds are not provided unless required under Australian Consumer Law. Faulty goods will be addressed as per legal obligations.

6. WARRANTY

6.1 The warranty is valid for 6 months on materials (unless otherwise stated) from the invoice date.

6.2 Warranties apply only to the original work location and require proof of invoice.

6.3 Customers must report defects within 48 hours of completion.

6.4 No warranty is provided for blocked drains, sewers, or stormwater.

6.5 Certificates of compliance incur an additional fee of $150 plus GST.

7. LIABILITY & INDEMNITY

7.1 The Customer indemnifies the Business against losses or claims arising from services rendered.

7.2 The Business is not liable for damages caused by conventional repair efforts on aged or deteriorated plumbing.

7.3 No warranty is provided for existing plumbing fixtures or conditions.

8. DRAINS & SEWER

8.1 Tree roots and blockages indicate potential pipe damage. Clearing a blockage does not guarantee it will not reoccur.

8.2 CCTV inspections are at the Business’s discretion and may incur additional charges.

9. RESTORATION

9.1 The Business takes reasonable care but is not responsible for post-work restoration, including painting, landscaping, or flooring repairs.

10. WATER/GAS AND ROOF LEAKS

10.1 Leak detection is a process of elimination, and repairs may require multiple attempts.

10.2 Roof leaks may not always be resolved on the first visit.

11. COMPLIANCE WITH LAWS

11.1 The Customer and Business must comply with all relevant laws and regulations.

11.2 Customers are responsible for obtaining necessary permits unless otherwise agreed.

12. GOVERNING LAW

12.1 This contract is governed by the laws of Tasmania, and both parties submit to the jurisdiction of Tasmanian courts.

13. WHOLE AGREEMENT

13.1 These Terms & Conditions constitute the entire agreement and supersede all prior understandings.

Black Stump Plumbing and Gas reserves the right to review & make changes to these Terms & Conditions at any time.
